KWANKWASO INDOORS OVER EFCC ARREST THREAT – LAWYER

Former governor of Kano State, Rabi’u Musa Kwankwaso has been in his house over the threat of arrest by the Economic and Financial Crimes Commission (EFCC), his lawyer Barrister Okechukwu Eze told a court in Kano yesterday.

In a motion exparte filed by Eze on behalf of Kwankwaso at the Gezawa High Court in Kano yesterday, Eze said the former governor has also been denied the liberty to perform his legislative duties as mandated by voters of Kano central district.  

He asked the court to stop the EFCC from arresting Kwankwaso over an allegation of misappropriation of pension fund as doing so would be in breach of his fundamental rights.

“My client has been in his house over the threat of arrest by the EFCC and has been denied the liberty to perform his legislative duties as mandated by voters of Kano central district. We fear that Kwankwaso’s right to liberty, freedom of movement as guaranteed under the constitution may be violated by EFCC,” Eze said.

  He noted that “EFCC has the power to investigate financial crimes, but it should be based and founded on reasonable suspicion”.

The move by the EFCC to arrest Kwankwaso followed a petition filled by Kano pensioners to EFCC, alleging that the former governor mismanaged their money amounting to N2 billion. 

The pensioners in the petition filed by their counsel Bashir Nasir &Co and signed by A. B.Bulama Esq to the EFCC alleged that the former governor deposited N2billion belonging to them in Euro Bank Plc, which liquidated shortly afterwards.

The former governor, through his lawyer, however faulted the petition and described the pensioners’ association as “unregistered”.  He said he was in the court to halt the likely “anticipation of violation of his client rights”.

  The judge, Justice Mohammed Yahaya reserved ruling till today.
